Update - New Prop A Writ of Mandate and Appeal

Dear All,

Last week I filed a Writ of Mandate seeking to have Prop A "Affordable" Housing bond, pulled from the ballot. You can read about it here. See attached with Exhibits.

Also, the Appeal was filed and served. Thanks to our own Phil Berg for being the only blind Process Server in SF history. Smile. They (the City) are of course challenging the Appeal. You can read our response to their motion to dismiss here. See attached. The Appeal and the new WRit filing are really the 1 - 2 punch. If the Writ of Mandate is enforced, and we should know that soon, it will greatly strengthen the case of the Appeal which is basically about the very same issues. The City is clearly in the wrong. We just need an hones judge if there is such a thing.

As mentioned earlier, it will cost something like $2500-$5000 to hire a friendly activist (read "inexpensive") lawyer to assist us with the Appeal paperwork. Appeals have their own structure so we would benefit greatly by having someone knowledgeable of the process working with us. Any contributions are greatly appreciated. Fortunately, I'm so poor the fees for filing the new Writ were waived and I'm requesting a waiver of fees for the Appeal too..

Looking forward to your comments, questions and contributions. Many thanks to Richard Michael for all his hard work.
