Re: document for LPSF Treasurer and other officers to sign

Thanks, guys. How about this language? It’s a bit longer, but words it in the first person and I think includes some helpful additions and tightens up some potential ambiguities:

I ___________(name)____________, having been duly elected or appointed as an officer of the Libertarian Party of San Francisco (LPSF) on (date), agree not to transfer or spend any funds or other assets of the LPSF to which I have access, without such transfer or expenditure having been duly approved by either a vote of the LPSF membership or of the LPSF officers.

At the end of my term of office, or if I resign or am removed from my position prior to its term expiring, I will promptly transfer control of any party funds and assets in my custody or to which I have access, including any relevant passwords or information in my possession necessary to securing the funds or assets, to the current chair or treasurer, except as may otherwise be directed by a vote of the LPSF membership or officers.

Nothing in this agreement shall be construed as requiring me to violate the law. If I believe I am legally required to transfer or spend funds in a manner that has not been duly authorized by the group, I will bring the matter to the attention of the other LPSF officers to either secure their approval for the outlay of funds before it is made, or allow them to accept my resignation if I do not wish to continue as an officer without it being made.

Hi Brendan,

Yes, my intention is for this to be the whole agreement. Let’s alter “except as provided in this agreement” to “except to transition to a new treasurer for the LPSF.”

Is this the whole agreement? It says “financial access will not be transferred… except as provided in this agreement” but then doesn’t provide any mechanism for transfer.

Hi All,

Based upon our discussion on January 10th, this is the language I propose for the agreement:

Agreement for Treasurer of the Libertarian Party of San Francisco County:

The treasurer agrees that financial access and records will not be transferred to any other party for any reason except as provided in this agreement. The treasurer further agrees not to spend party money unless required by law, or as approved by a majority of the current officers of the LPSF.

Hi John,

Thanks for your message, didn’t realize you were following the LPSF. Are you still living in Petaluma? You’re welcome to be on the LPSF email list without living in SF, of course, though we haven’t had so much traffic there recently.

The correspondence below arose when it was suggested that there be some kind of written agreement for the treasurer and other officers to sign, to ensure they won’t abscond with party funds or just unilaterally spend party assets without go-ahead from the group. This wasn’t prompted by concerns over the trustworthiness of any individual, but there has been some disagreement about our possible legal obligations regarding filing government paperwork.

Is there an active LP chapter where you are, or been up to anything else libertarian-wise yourself lately?
