This is a proposal for you to save yourpresidential candidacy by appealing to the parties to the more than 50 million lawsuitsthat are filed in the state and federal courts every year(*>jur:84,5),to whom must be added those to the scores of millions of suits that are pendingor deemed to have been wrongly or wrongfully decided. 2. By operation of lawsuits, half of the parties to them lostin court. But even the other half did not win all their “Relief Requested” intheir briefs, for judges do not even read the vast majority of briefs. a. Among them are the parties to 93% of federal appeals, whichjudges dump out of their caseloads by having their clerks rubberstamp 5¢dumping forms, which according to official statistics(†>OL2:457§D) are “[on]procedural [grounds, e.g., the catchall pretext of “lack of jurisdiction], unsigned, unpublished, without comment, and byconsolidation”. A similarsituation obtains in the state courts(OL2:760). 3. The parties and their friends and family, workmates,associational fellows, members of their racial, ethnic, gender, and religiousclass, etc., are affected by, in general, judges and, in particular, federaljudges, the public ‘servants’ who wield the most power over people’s property,liberty, and all the rights and duties that frame their lives and shape theiridentities. 4. For their personal and judicial class benefit, judgesdisregard the factual and legal constraints of suits, frustrating people’sreasonable expectations of obtaining justice by the rule of law. Judges abusetheir power because they are held by themselves and the politicians who putthem on the bench unaccountable. 5. A leaderless national constituency has arisen that isreceptive to the appeal of a courageous national leader: the huge untappedvoting bloc of The Dissatisfied with The Judicial and Legal System. 6. No doubt your denunciation of judges’ abuse of power at apress conference and at every rally, townhall meeting, and interview will be abold and risky move. 8. But you are in a desperate situation: You have less than1% of the national vote and risk not meeting the tougher requirements for participatingin the 3rd presidential debate or receiving the donationsindispensable for running your campaign. 9. Moreover, boldness is the current ticket to survival: Thefive presidential frontrunners are the talk of the media because they are dealingwith bold, new, albeit costly governmental programs of benefits. 10. There is something that motivates people much morestrongly than somebody else’s offer of a benefit: that constant, burning feelingthat one has been abused and is impotent against the abuser. 11. Nothing is so visceral and energizing as the passiondriving a quest for justice. This is proven by the explosive transformation froma social system where sexual abusees suffered in isolation, shame, and silence intothe national people with the self-assertive attitude of the MeToo! movement, everywhere shouting the rallying cry: Enough is enough!
We won’t take any abuse by anybody anymore. a. The MeToo!movement coalesced overnight after the publication by The New York Timesand The New Yorker on October5 and 10, 2017, respectively, of their exposés of Harvey Weinstein’s sexual abuse. b. That is precedent for the expectation that your Emile Zola’sI accuse!-like(*>jur:98§2)denunciation at a press conference or in an article(†>OL2:719) of judges’ abuse can causethe eruption of the untapped voting bloc of The Dissatisfied with the Judicialand Legal System in time for you to save your presidential campaign. 12. The Dissatisfied constitute the best possible audience:one that is already gained to your denunciation of judges and searching for a leaderthat vindicates their claims. You stand to become We the People’s Champion of Justice. B. My offer to present to you examples of judges’ abuse and the strategyfor your survival 13. The nature, extent, and gravity of judges’ abuse willoutrage you and the rest of the public. At no cost to your campaign, you will prompta generalized investigation by the media –“Scandalsells the most”- and journalists in pursuit of a Pulitzer Prize story; andresignations by judges, who are the most vulnerable officers to criticism forfailing “to avoid even the appearance of impropriety”, as required byCanon 2 of their own Code of Conduct(jur:68123a). 15.
