The Constitution requires Congress to declare war, but it does not specify
the form that declaration must take. In this case, Congress authorized the
president to use all due and necessary force, or some bureaucratic crap
like that; I've seen it rather convincingly argued that that is a
declaration of war sufficient for Constitutional arguments. I think that
this line, like arguing the illegality of the federal income tax, is futile.

However, if the president knowingly lied to Congress, or if he was deceived
by his advisors into lying to Congress, in order to secure a declaration of
war, then I think that ought to be actionable.
