The case has been delayed: The reason is when I filed the case yesterday
morning at 9:00 AM sharp (because I tried to file the case the previous day
at 5:00 PM but they shut and locked the door on me when I was standing
there waiting to enter). they asked me if I had a previous case in the
Southern District New York. I told them I did. I had a 2013 case before
Judge Alison Nathan. So they said that they have to ask Judge Nathan if she
wants to take the case or not. If she does not want the case then they will
assign it to a random judge.
Now nearly two days have passed and the case has not been assigned because
they are waiting to hear from Judge Nathan (who might not even be there
today.)
I tried to call Judge Nathan's Chambers Phone: (212) 805-0278 to alert her
and her clerks that this is an election case and under New York State Law
Election Cases are to take priority over all other cases and under Erie
Railroad Co. v. Tompkins, 304 U.S. 64 (1938) the federal courts must follow
state law in matters such as this and therefore Judge Nathan must drop
whatever she is doing and decide whether she wants to take this case or not.
When I tried to call Judge Nathan's chambers to inform this that this case
concerns a primary election that is due to take place on September 10,
2015, the person who answered the phone said that they only talk to lawyers
and since I am not a lawyer they cannot talk to me. They said I have to
call the pro se office but when I did they said they have no authority to
contact the judge.
Would somebody who really is a lawyer please call Judge Nathan's Chambers
Phone: (212) 805-0278 and explain to them that this case is time sensitive
and MUST BE DECIDED TODAY. Otherwise it might be weeks before Judge Nathan
gets around to looking at it and the election will have been held long ago.

I do not know if somebody called the judge as I had requested but
immediately after that at 3:32 PM Judge Alison Nathan declined the case as
not related. It was then assigned by the wheel to Judge Lorna G. Schofield
and Magistrate Judge Andrew J. Peck is so designated.
So now we have a judge. Now the question is will an order to show cause be
issued today or will the judge wait until after Labor Day weekend to look
this case and discover to her horror that it is too late.
