At my readiness hearing on Wednesday, the judge surprised us by agreeing to continue (i.e. "postpone" in plain English) the trial so that we have time to file a motion seeking to dismiss the prostitution charge on the basis that the Supreme Court in striking down anti-sodomy laws ruled in favor of a right to privacy between consenting adults (Lawrence v. Texas). Of course this is no guarantee he will actually rule in my favor for dismissal -- he certainly hasn't been much use up until now -- but introducing the argument, win or lose, means that the point can be raised again on appeal if it comes to that. Perhaps, as my attorney suggested when noting that the judge looked interested, he granted the delay simply because he's curious to hear what we will say. I am starting to feel a bit like Scheherazade -- keep us entertained, and we will spare you. 8)
Meanwhile, please let me know if you have any leads on attorneys who can provide additional help with the research of this motion; it is evidently somewhat of an untraveled path. I'm expecting to get some info from one other lawyer on it, but she hasn't been too communicative of late, and my own attorney has a busy calendar and no experience with this particular angle, so we could use whatever assistance we can get.
Thank you to those of you who have asked about my case and expressed an interest in attending the trial. I hope you will still consider coming when it starts on October 29th (you're welcome at the hearing on the morning of the 24th too if you want to go the extra mile, but having folks visibly in support when the jury's there is what matters most). The trial will apparently start in the afternoon (1pm?), and the best guess appears to be that it may last about three days, although such things are never certain. Well, until next month...
