I'm not sure the problem with the judiciary is that it is Constitutionally _weak_. To a considerable extent, at least, it looks to me as though the problem is that the perspective of the judiciary does not differ from that of the legislative or executive branches. The problem, from one point of view, is that judges are people. They're as ignorant and venal as the rest. On two points we appear to agree: the ignorance of the populace (not counting us), and the idea that we're doomed.
