I don't have an immediate opinion on a lawsuit, though it's an
intriguing idea; but, for what it's worth, I think Stern is right that
"agencies do it all the time." The Regents of the University of
California regularly take official positions on ballot propositions, and
I've saved a number of issues of the UCSF newsletter with editorials
from top administrators essentially telling us how to vote. Sometimes
there is a fig leaf: "While UCSF takes no official position, we urge
you to consider carefully the crucial benefits that UCSF would derive
from Proposition X." I called the University legal office once years
ago, and the person I spoke with admitted that it was a "gray area."
The fact that the practice is so widespread might mean that we had a
really big case, but that might mean in practice that it was guaranteed
to receive no public attention.
