- Justice H. Walter Croskey, in the opinion holding that California parents do not have the right to home school their children.

Justice Croskey was only quoting this sentence from a precedent, the 1961
case "In re Shinn".

His ruling is still terrible for home schools, however. In this case the
parents had enrolled their children in a private school which administered
the state-mandated tests and supervised their education to the satisfaction
of the school's state-licensed "educators". But Justice Croskey ruled that
the students had to be physically present inside a school building to
qualify as "in a private school". He further ruled that Section 51745 of the
Education Code allows public schools to give credit for study outside of
school, even in foreign countries for example, but does not allow private
schools to give such credit for students being taught at home.
