legal help with initiative, etc.

I think Sean Elsbernd would be a good one to start with. I'm in the
process of trying to schedule us a meeting with him anyway. What are
the names of the lawyers you're trying to get? I assume PLF is Pacific
Legal Foundation? What led you to approach them, and what did they say
exactly? Has anyone spoken with the City Attorney's office? They will
supposedly help with drafting language at no charge, but we don't want
to rely on them as our primary legal advisor I think.

Approaching Super Shuttle is a great idea. There are a number of other
companies in that business too. I agree that publicizing the
initiative, even circulating it in advance of getting signatures, can't
be illegal. On further thought I don't think we should give out copies
though, unless we're 100% sure the recipients are allies who won't
spread it around indiscriminately. No sense in giving the opposition
any material to start looking for weak points in before we have to. We
could have a "booth copy" for people to look at though.

No reply after two messages left for lawyer suggested to call first. I
will e mail him them one more call. PLF lawyer might helppp if we
can't find anyone else. He did offer PLF for any appeals. Avery
valuable offer in the long run. Will start approaching Super Shuttle
to find out if they can help or advise on lawywr. I am starting to
think we should approach a friendly Supervisor to either introduce a
bill or better yet use her offices to prepare a bill that we could
then use. Suggestions as to best supervisor and anybody who can help
greatly appreciated.

Phil

Oh and looking for help and publizing the idea and that we are working
on it can't possibly be illegal, and if it is the law is a slam dunk
violation of the first amendment. You are charged with conspiracy to
propose an iniative.

Starchild, Phil, and Mike,

1. Yes, I thought I read somewhere that you could ask the District
Attorney's Office for help; I would assume very minimal help, but it
would be a start.

2. Well, here is a *tentative* offer on my part: If the Golden Gate
or Hastings Clinics, the DA's Office, or the attorney Starchild knows
do not offer any help, I will e-mail a client of mine who did succeed
in placing an initiative on the ballot, and ask for his help. I say
*tentative* because I may get cold feet, mixing LP and business.
Also, I would like to have Phil and Mike's OK before I pursue that.

3. Is there any way that we could get a legal decision whether or not
we can publicize a Ballot Initiative before the initiative is filed?
I know about First Amendment and all that, but this is the government
we are dealing with, and they do not believe in the Constitution! I
could call the Elections Department and ask, but would they answer in
our favor, no matter what the "rules"? I sure would appreciate some
feedback on this.
