Gun Ban

Hi All,

Richard Newell of EBL has suggested LPSF address the upcoming proposed gun ban on the November city ballot. We will be discussing all propositions in our meeting of August 13, including the gun ban. I will introduce Richard's resolution for a vote. Also, we will briefly discuss resolutions and their political purpose.

Please see Richard's wording below.

Hope to see you all on August 13!

Marcy

Very nicely written resolution, Richard! I have only one proposed change, which is to change the word "lawful" to "moral" in the sixth paragraph. (Many uses of firearms which are perfectly acceptable by libertarian values are currently held to be "unlawful" by local, state, and federal officials, and we want to clearly speak out not only for the freedom to use guns in ways they consider lawful, but in all ways which are moral, whether they deem them legal or not.)

  Marcy, I don't know who has suggested that discussing resolutions and their political purpose should be an item on the agenda, but unless there's more to the item than meets the eye, I would question the need for it. Does anyone here believe it is a waste of our time to pass resolutions? If so, then let him or her bring the issue forward. If not, then why don't we save the time and move on?

  I would be happy to discuss the merits of passing resolutions one on one with anyone who is simply curious about their political purpose without necessarily being opposed to them. Perhaps a bunch of people will speak up and prove me wrong, but I believe that most of our group already understands the benefits of adopting an occasional resolution, so long as we do not become so enamored of the activity that we start to look as ridiculous as some legislatures do. If this understanding exists, then a discussion of the topic would not be of much value compared to other possible uses of the time.

How's this:

Resolution to Oppose the San Francisco 2005 Ballot Measure
"Prohibiting Firearms Distribution and Limiting Handgun Possession"

WHEREAS the right to defend oneself is a natural human right; and

WHEREAS handguns are one of the most effective tools for this purpose; and

WHEREAS the City and County of San Francisco has placed on the November 2005 ballot a "gun ban" measure that would prohibit handgun possesion by residents, and would require surrender of all handguns possessed by residents within it's corporate boundary, and would ban the sale or transfer of ALL firearms and ammunition, with only minor exceptions such as for non-residents, certain law enforcement officials, and other government employees; and

WHEREAS under this measure the former owners of handguns so confiscated would not be granted any compensation, and

WHEREAS the measure would effectively put out of business an ongoing firearms retailer within the city limits, thus destoying the owner's equity in the business as well as the owner's and employees' livelyhoods, also without compensation;

BE IT THEREFORE RESOLVED THAT the Libertarian Party of San Francisco reaffirms the right of San Francisco residents to possess handguns, whether for self-defense or sport or any other lawful purpose, such as they see fit;

BE IT FURTHER RESOLVED THAT the Libertarian Party of San Francisco reaffirms the right of individuals and the businesses they create to participate in a free and open market in firearms and ammunition; and the right to own and operate or to be employeed in firearms related businesses, without them being arbitrarily and capriciously shut down;

BE IT FURTHER RESOLVED THAT the Libertarian Party of San Francisco considers confiscation of legally obtained private property, namely handguns, to be an improper function of government, whose role should instead be to protect private property; and that this impropriety is compounded by not granting just compensation to the former handgun owners; and finally

BE IT THEREFORE RESOLVED THAT the Libertarian Party of San Francisco wishes it to be known far and wide that, for these and other reasons, it opposes the ballot measure "Prohibiting firearms distribution and limiting handgun possession" that is slated to appear on the ballot in San Francisco in November, 2005.

You can see the text of the proposed law, here:

I would appreciate it if you or one of the LPSF members would submit this for a vote of the members present. I would hope that, amongst Libertarians, this would be fairly non-controversial; so long as people don't get into picking over every word.

Please let me know the outcome.

Hi Richard,

Being passionate about everything is good; on behalf of LPSF, thank you for the compliment!

As I recall, Mike Denny is on vacation in Brazil, and will not be back for a while.

I will either:

1. Introduce for membership vote any resolution I receive.

2. OR When we discuss the propositions at the meeting request a motion for a resolution to be drafted.

Marcy,

I am surprised there is not more passion. Your little group seems to be passionate about everything else! (Just kidding around with you.)

More seriously, I know that Mike Denny is featured on the Committee to oppose the SF gun ban's web site:
http://www.opposegunban.com/

If I can find the time, perhaps I can draft a short 'non-controversial' resolution and you or Mike could submit it for a vote. I don't think that I will be able to attend your meeting this weekend - it's already chock full of Libertarian stuff. I have copied Mike on this email, and welcome any suggestions either of you have.

Hi Richard,

No resolution passed at the LPSF. I brought the subject up a couple of times on the Activist List; there did not seem to be any passion about this.

One of the items in this month's LPSF Agenda is to review all the propositions on the November ballot. I made copies of the text of as many as I could and said I would distribute to those who pledged to write ballot arguments by the deadline of 8/19/05 (or used the text for any other useful purpose). This would also be a good time to suggest resolutions, which I will do.

I am planning to print the meeting agenda on Friday 12. So if you would like three minutes or so on the agenda to speak about the gun ban, please let me know before Friday 12.

Hi Marcy,

Has the LPSF passed any resolutions in opposition to the gun ban?

If so, would you please send it to me? If not, I suggest it is high time! Perhaps something could be done at this weekend's meeting.

Starchild,

You asked if someone suggested "discussing resolutions": I did. We
will take two minutes to review my suggestion regarding resolutions.
Sorry if I sounded as if this was going to be a long-drawn out
discussion.

I accept that change of wording as a "friendly amendment". Thanks, Starchild.

The reason I proposed this particular resolution is that it serves as a bridge to the other gun-rights groups, allowing them to easily mention the LP support on their web sites (bringing us more exposure), and also allows the LPSF to justify a press release. I will follow-up on the former, assuming the resolution passes; and I hope someone in the LPSF follows up on the press release potential.
