Govt Money and Free Speech...Re: Please sign this petition

From what I have heard, this petition below promoted by libertarians is also is an example of a (assumedly?) state school banning someone for speech. (Assuming she wasn't throwing eggs at school events or whatever.)
            I don't know if this is a result of federal mandates of some kind or just political correctness run wild. Some libertarians DO say that if you take any government money you don't have a right to complain about govt restrictions, and in some cases we'd all agree (i.e., don't spend education money meant for books on wild parties for teachers). But frankly if we aren't active against the government trying to squelch free speech -- on all sides of any issue -- on any campus that takes government money (which is most of them) we won't look much like defenders of free speech and will just be doing the work of the state. Not to mention what's next -- use government roads and you have no right to free speech??

Exactly why was Tatiana Menaker expelled as a student at SFSU? I do

not see anything on the petition or in your request which gives any
indication of what happened to get Tatian booted out of SFSU. What was
the process which was used to get her removed as a student? Some
explanations of what went on would be very helpful before you asked
people to blindly sign petitions.

  While I don't know the full details of what happened, having gone to SF State myself and being familiar with how politically correct the school is, I was willing to sign the petition on the basis of making an educated guess that Tatiana's version of events is more or less accurate. Should I later decide this is not the case, I can always ask that my signature be removed.

  When making political decisions, I find there is usually a certain amount of educated guesswork involved. Rarely do I feel I have absolutely *all* the facts necessary to make an informed choice.

  Having said that, I encourage anyone willing to dig for the facts as you are doing. I only hope that you also make time for real-world activism on behalf of the libertarian cause. Have you done anything for the Libertarian Party or for liberty offline in the past week?

Dear Starchild;

Yes I sent a letter to the editor today opposing the Examiner on the Editorial article they had today supporting the Congressional $10 million taxpayer give away to restore the California missions. I wrote the objection using my name and stating I was a Libertarian. I am awaiting a response. This is a copy of what I sent to the Editor.

Dear Editor;

Please show me where in the US Constitution it says Congress is authorized to take $10 million of the taxpayers money and give it to the Catholic Church to repair ITS California Missions? This is forced philanthropy and is nothing more than illegal plunder. If the Catholic Church is so concerned about the fate of its California Missions why doesn't the Catholic Church do a fund-raising program? There are 10 million Catholics in California. Each Catholic in California could contribute a Single Dollar to meet the funds needed to do the restoration. You do not need the taxpayers money.

I almost forgot there was an OP/ED article in the NY Times supporting a national ID card. I wrote a strong response to the Editors on that one and the columnist quoting Libertarian principles and my name as a Libertarian.

Dear friends,

It’s a full-scale war going on. University administration is lying.
First, they issued the press release claiming they only suspended me for
14 days, while Donna Cunnigham, coordinator of Judicial Affairs, personally
declared to me that I was being expelled and handed me the paper to sign.
It said that I was being suspended from San Francisco State University for
five years, from Spring 2004 to Spring 2009 , and that I would be required to
apply for re-admission. Considering that there is no certainty of my being
re-admitted, it does appear there to be an expulsion or an action
equivalent to one.

University stated that I had 6 police reports in two years.

Police report #1.
1. I was punished with 40 hours of community service for an alleged “hate
crime” when on May 7 2002 during anti-Semitic riot at SFSU, when
Palestinian hooligans surrounded participants of a Jewish peace rally with bull horns,
whistles and drums screaming “Death to Jews!” “Hitler didn’t finish his
job!” “Go back to Germany, Germans will take care of you!” “Zionists out
of campus!” I shouted back at the crowd “Go, f-ck your camels!” and used the
word “bitch”. Perhaps I shouldn’t have but murderous threats were very
upsetting. Palestinians filed a report against me for the hate crime
falsely accusing me of using the epithet “sand nigger”, an expression entirely
unfamiliar to met at the time. My chief accuser, Palestinian leader Leila.Quatami didn’t appear at the
disciplinary hearings. The witnesses against me were Kenyatu Muatta, black advisor to Muslim
Organizations on campus and Suahir Nassar, the leader of GUPS (General
Union of Palestinian Students). Nassar honestly said he did not hear me utter
the words “sand nigger”. I asked Muatta when during the two-hour rally he heard me use those words. He said it happened at the end of the rally, not knowing I was only
present at the rally for first 20 minutes. At the time he claimed I was there, I
was in fact in my class reporting on Steinbeck for my final exam. Even the
administrative judge Anderson concluded that I hadn’t uttered, nevertheless, I was punished with 40 hours of community service and put on probation.

Police report #2
After the lecture proving that the bad image of Arab terrorists is just a
creation of vicious Hollywood screenwriters, (even those with the mostly
inflamed imagination couldn’t have predicted the 9/11 terror attack)
Kanyatu Muatta, who bore false witness against me, mistakenly tried to
shake my hand. I told him that I would not give my hand to a liar, who
falsely testified against me. He then hurried off to complain to Donna
Cunningham..

Police report # 3.
During the explosion of anti-war propaganda on campus perpetrated by very
active ANSWER (Act Now to Stop War & End Racism) chapter running with
Palestinians under the same slogan “Free Palestine, Stop the War in Iraq!”
the short fellow was scribbling anti-American, anti-“imperialist”,
anti-war graffiti with color chalks in the front of the Student Services building.
The University employee tried without success to stop him from defacing
University property, But he was not to be deterred. I told him that if he
doesn’t like this “imperialist” country so much why wouldn’t he return to
his own?” He accused me for being a racist and in police report claimed I
used the term “you dark skinned people“which I did not.

Police report # 4.
I visited “SAW” (Students Against War) the center of anti-war propaganda
run by ANSWER representative, who under patronage of University philosophy
professor “comrade Robertson” described by me in my FPM article runs all
pro-communist, anti-American, anti-Bush, anti-Israeli activities on
campus. One is left to wonder when these “students” have time for their studies.
The little graffiti guy, Hernandes, said that I am a racist and they will
not conduct their meeting in my presence. I said that I am a full-time
student and have the right to attend. They called the police. After
conversation with the policemen I attended the meeting until the end. But
the incident was recorded.

Police report # 5.
During anti-war meeting on campus, a passionate speaker against the war
with Saddam Hussein, tall woman was introduced as Leila Quatami, leader of the
Palestinian students. This is how I found out who my mysterious accuser.
Many months later I ran into her at the University Plaza.
What are you supposed to do, when you are suddenly confronted by the
person, who’s false accusation has ruined a year of your life? I was arrested,
read my Miranda rights, charged with committing a crime , a charge later
dropped by the District Attorney. I spent numerous hours in a lawyer’s office as
well as eight hours in University disciplinary hearings. I was obliged to
perform 40 hours of community service, suffered unbelievable stress which
resulted in ulcer, incurred tremendous losses in business, and a major
reduction of time with my children. Would you remain silent? I told
Quatami that she falsely accused me, that she was a liar and a coward, and that
she would be punished for this, that she ought to travel to lick Saddam
Hussein’s ass (not a good idea…).

In my “FronPageMagazine” article “College Film Festival: Kill the Jews” I
described a socialist professor who “was so hysterical in her hatred
toward Israel that even the Palestinians in the audience were bewildered.” This
professor Deborah Gerson by using her Jewish name shuts up every
pro-Israeli voice on campus. When two Jewish biology students protested depiction of
suicide bombers as martyrs at the University newspaper, she wrote a letter
denouncing them and stating that they are not representing the Jewish
voice. I am puzzled by the inclination of the few Jewish intellectuals to join
murderous Arab crowds, openly declaring that they want Jewish people dead.
I ran into Prof. Gerson after the event on campus I asked her for interview.
She refused to talk to me. So I told her that if doing what she was doing
she thought she will be spared when the murder of Jews began, she was
mistaken; she too would be killed exactly the same way as every other Jew,
just two hours later. Leaving the room I turned and looked at her. The
mystery was solved. I saw a scared to death little Jewish girl on the
dirty street of Brooklyn surrounded by anti-Semitic bullies. She was scared to
the end of her life. These people fighting their own fear of being Jewish,
join the enemy, without even trying to beat him. Prof. Gerson filed a complaint
with police and I was summoned to Student Affairs Judicial coordinator
Donna Cunnigham.

  The appointment was not a pleasant one. I brought her a stack of “Free
Palestine, no War in Iraq” leaflets littering every stall in the restroom,
glued to the glass doors and the walls to the Humanities buildings, and
told her that the University is patronizing radical leftist groups on campus.
When she informed me that Professor Gerson complained that there was a death threat
against her, I told that I want Ms. Gerson to look me in the eye and
repeat my actual words. I told her that I am not participating in kangaroo court
I was subjected the first time, that I have the right to see my accuser.
In Ms. Cunningham opinion, my voice was too loud. She told me that she is
expelling me. I answered that this is unfair, that the University
administration is used by socialist, anti-American, and anti-Israeli
groups on campus for destruction of their political enemies. She called the
police. In a very quiet tone I was trying to persuade her not to expel me
because it was nothing more but political revenge. To my shame, even the
police officer wrote in his report 'Ms Menaker was pleading not to be suspended.' I didn't
realize that the decision regarding my 5 year suspension with no guarantee
of being readmitted was prepared before my arrival in her office. Ms
Cunnighan, the University Coordinator ofJudicial Affairs, needed this
little comedy to justify a decision already made and committed to paper.
My lawyer advised me not to make any statements. He wants to settle the
case. Cunningham claimed I was throwing things around her office and
entered her private space. Except the desk and three chairs, there is nothing to
throw. Somehow all the people who complain against me say the same thing that
they are physically threatened by me. I never realized that a plump Jewish
woman over 50 years old is such a scary looking person. My only physical
activity is Chinese dance group once a week. The disciplinary hearings are planned for March 15 and will demand from me an athletic energy. I will be accused of being a racist. It takes a lot to
face people who are prepared to lie about you. Wish me luck.

Dear Starchild;

Thank you for forwarding the info it was very helpful in providing some insight into what happened. From the info I do remember reading newsreports about one or two of the incidents. But did not know who the players were.

The events make me think back to earlier Vietnam war protests on the SFSU campus. And good old S.I. Hayakawa jumping on a sound truck and tearing cables off the loud speakers. Sure sounds like todaythere are no professors out there with those kind of guts to stand up to anyone for any reason.

One of my earlier questions still remains to be answered from March 14 hopefully by Vargas Painting.

suicide bombers as martyrs at the University newspaper, she wrote a
letter
denouncing them and stating that they are not representing the Jewish
voice. I am puzzled by the inclination of the few Jewish intellectuals
to join
murderous Arab crowds, openly declaring that they want Jewish people
dead.
I ran into Prof. Gerson after the event on campus I asked her for
interview.
She refused to talk to me. So I told her that if doing what she was
doing
she thought she will be spared when the murder of Jews began, she was
mistaken; she too would be killed exactly the same way as every other
Jew,
just two hours later. Leaving the room I turned and looked at her. The
mystery was solved. I saw a scared to death little Jewish girl on the
dirty street of Brooklyn surrounded by anti-Semitic bullies. She was
scared to
the end of her life. These people fighting their own fear of being
Jewish,
join the enemy, without even trying to beat him. Prof. Gerson filed a
complaint
with police and I was summoned to Student Affairs Judicial coordinator
Donna Cunnigham.

The appointment was not a pleasant one. I brought her a stack of �Free
Palestine, no War in Iraq� leaflets littering every stall in the
restroom,
glued to the glass doors and the walls to the Humanities buildings, and
told her that the University is patronizing radical leftist groups on
campus.
When she informed me that Professor Gerson complained that there was a
death threat
against her, I told that I want Ms. Gerson to look me in the eye and
repeat my actual words. I told her that I am not participating in
kangaroo court
I was subjected the first time, that I have the right to see my accuser.
In Ms. Cunningham opinion, my voice was too loud. She told me that she
is
expelling me. I answered that this is unfair, that the University
administration is used by socialist, anti-American, and anti-Israeli
groups on campus for destruction of their political enemies. She
called the
police. In a very quiet tone I was trying to persuade her not to expel
me
because it was nothing more but political revenge. To my shame, even the
police officer wrote in his report 'Ms Menaker was pleading not to be
suspended.' I didn't
realize that the decision regarding my 5 year suspension with no
guarantee
of being readmitted was prepared before my arrival in her office. Ms
Cunnighan, the University Coordinator ofJudicial Affairs, needed this
little comedy to justify a decision already made and committed to paper.
My lawyer advised me not to make any statements. He wants to settle the
case. Cunningham claimed I was throwing things around her office and
entered her private space. Except the desk and three chairs, there is
nothing to
throw. Somehow all the people who complain against me say the same
thing that
they are physically threatened by me. I never realized that a plump
Jewish
woman over 50 years old is such a scary looking person. My only physical
activity is Chinese dance group once a week. The disciplinary hearings
are planned for March 15 and will demand from me an athletic energy. I
will be accused of being a racist. It takes a lot to
face people who are prepared to lie about you. Wish me luck.
